1. Agreement to Terms
By accessing or using TotalAnesthesia (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you ("User," "you") and TotalAnesthesia ("Company," "we," "us," "our"). We may modify these Terms at any time by posting the revised version. Your continued use after any changes constitutes acceptance of the new Terms.
2. Description of Service
TotalAnesthesia provides:
- AI-powered clinical decision support and information retrieval
- Medication dosing calculators and reference tools
- Clinical guidelines and protocol references
- Educational content for board examination preparation
- Pre-operative assessment support tools
The Service is designed to assist qualified healthcare professionals and medical students in their practice and education. It provides information derived from published medical literature and guidelines.
3. Eligibility
To use the Service, you must:
- Be at least 18 years of age
- Be a licensed healthcare professional, medical student, resident, fellow, or other individual with legitimate professional or educational need
- Have the legal capacity to enter into binding agreements
- Not be prohibited from using the Service under applicable law

4.1 No Medical Advice
THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE. All content, including AI-generated responses, dosing calculations, guidelines, and educational materials, is provided for informational and educational purposes only. Nothing in the Service constitutes professional medical advice, diagnosis, or treatment.
4.2 No Doctor-Patient Relationship
Use of the Service does not create a doctor-patient, provider-patient, or any professional healthcare relationship between you, your patients, and the Company.
4.3 Professional Responsibility
You, as a licensed healthcare provider, retain sole and exclusive responsibility for:
- All clinical decisions and patient care
- Direct patient assessment and examination
- Verification of all information from any source, including this Service
- Exercising independent professional judgment
- Compliance with applicable laws, regulations, and standards of care
- Obtaining informed consent from patients
4.4 Information Accuracy
While we strive to provide accurate information from reputable sources, we make NO WARRANTY that any content is complete, accurate, current, or error-free. Medical knowledge evolves rapidly. Drug dosages, indications, contraindications, and protocols may change. YOU MUST INDEPENDENTLY VERIFY ALL CLINICAL INFORMATION before any patient care decision.
4.5 AI Limitations
Our AI system may produce responses that are incomplete, outdated, or incorrect. AI-generated content should be treated as a starting point for research, not as definitive clinical guidance. The AI cannot account for individual patient circumstances, comorbidities, or factors known only to the treating clinician.
5. Acceptable Use
You agree NOT to:
- Use the Service as a sole or primary basis for clinical decisions
- Enter Protected Health Information (PHI), patient names, medical record numbers, or other patient-identifying information
- Rely on the Service without independent verification
- Use the Service for emergency medical situations (call emergency services instead)
- Share your account credentials with others
- Attempt to reverse engineer, copy, or extract our systems or content
- Use automated systems to access the Service without permission
- Use the Service to develop competing products
- Violate any applicable laws or regulations
6. User Accounts
You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities under your account. You must notify us immediately of any unauthorized use.
7. Intellectual Property
The Service, including all content, features, and functionality, is owned by the Company and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
- THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
THE COMPANY SHALL NOT BE LIABLE FOR ANY PATIENT OUTCOMES, CLINICAL DECISIONS, MEDICAL ERRORS, OR ADVERSE EVENTS RELATED TO USE OF THE SERVICE. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF ANY INFORMATION PROVIDED BY THE SERVICE.
10. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Any clinical decisions or patient care you provide
- Any claim that your use of the Service caused damage to a third party
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination shall survive (including disclaimers, limitations of liability, and indemnification).
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Wilmington, Delaware. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
13. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements.
